TRAI GUIDELINES

  Dear Customer
  We would like to update and brief you about the new TRAI (Telecom Regulatory Authority of India) guidelines come in effect due to the increasing number of complaints on spam and telemarketing messages.

The new policies are due to come in effect from 26th September, 2011.  The policies ensure Communications are complaint and do not interfere with the customers privacy in any way. Click here to know more about updated TRAI (Telecom Regulatory Authority of India) guidelines.
  Responsibilities
  Indyarocks shall share two kind of accounts defined transaction and promotional, the categories are explicitly defined in the guidelines.  All existing accounts would need to be converted to Promotional accounts and Indyarocks shall have separate accounts for pushing transactional communication only if TRAI permits.
  Transactional Messages:
  The only communications to be received by the user registered in the NDNC registry, are Transactional message which include and is limited to the below stated:

  • Information sent to its customer(s) by the Bank or financial institution or insurance company or credit card company or Access Provider pertaining to the account of that customer(s):

  • Information given by Airlines or Indian Railways or its authorized agencies to its passengers regarding travel schedules, ticket booking and reservation.

  • Any other message as may be specified by the TRAI, from time are considered “ Transactional Messages” and sent to all mobile subscribers irrespective of whether they are on the NDNC / NCPR registry.

  • Eg. Above stated are as follows:


  • Amt. of INR 9000.00 deposited to A/c XXXXX4258 towards CHQ DEP-MICR CLG-MUMBAI-CLEARING value 11 Jan 2011. Cheque credits subject to clearing.

  • Transaction of Rs. 468.49 made on SBI Credit Card XXXX2238 at PAYPAL *FILESERVE on 10 Jan 11.

  • Dear Guest, Thank you for choosing Kingfisher Airlines.  Your booking is confirmed on Kingfisher Airlines flight IT104/21/AN BLR-MUM @0905 hrs . IT111/21JAN MUM-BLR @18.30 hrs. Your PN is NNFNFM. Guests who are travelling are requested to carry a valid ID proof for verification at the airport.

    Note: No footer with promotional text to be included while sharing the transaction information.  Such messages too shall be listed in unsolicited text messages.

  • For Eg: Amt. of INR 9000.00 deposited to A/c XXXXX4258 towards CHQ DEP-MICR CLG-MUMBAI-CLEARING value 11 Jan 2011. Cheque credits subject to clearing. Use HDFC Credit Card top enjoy 5% cash back.
  •   Promotional Messages:
      All message(s) containing commercial communication / calls or advertisement of a product or service will be considered as promotional messages.  Promotional SMS can be pushed only between 9 am to 9 pm and not during other hours.  Also, every promotional SMS sent should contain unique Sender Name irrespective of the product / brand  being promoted.  All promotional messages will be subject to DND scrubbing.

    Also certain messages which seem to be transaction as listed below but are not limited to the following shall be considered Promotional and need to go through  the DND check.

  • Message sent by courier services about details of tracking ID, status of courier.
  • All subscrip0tion service, in case of people who have opted for subscription shall also go through DND check and subscrip0tion shall not be valid for users registered in DND.
  • Information from a educational institution to parents or guardians of its students;
  • DTH services, giving balance of the account, recharge reminders are also listed in promotional category.
  • Stock Broking alerts;  One time password, Stock values, and Replenish margin alerts.
  • Registered users of social networks to receive alerts
  • Services like just Dial will need to send all messages through DND check.

      For Promotional Communication:
    XY-NZZZZZ
    Where :
    X : Stands for Operator Connectivity
    Y : Stands for Circle Area.
    N: Indicates that this SMS belongs to one of the categories as mentioned below and in which the enterprise operates in

    ZZZZZ: indicates five digit unique code allotted to Indyarocks by the Services Provider.
      For Transactional Messages:
      XY-ZZZZZZ
    Where :
    X : Stands for Operator Connectivity
    Y : Stands for Circle Area.
    N: Indicates that this SMS belongs to one of the categories as mentioned below and in which the enterprise operates in
    ZZZZZZ: indicates Six alphabets for company or organization sending transaction SMS or it will be similar as defined for Promotional Message ( The clarity is still pending from TRAI).

    Indyarocks shall set up a process and set up an infrastructure to scrub the messages against the entire DND database.

    We shall also provide assistance for assigning the new Account details for Transactional messages (ifTrai permits)
      Why adherence is mandatory?
      TRAI has established strict penalties.  The sender will be levied a penalty of Rs. 25,000/- on the first complaint and this may rise to as high as 2.5 lakhs for the sixth complaint.

    In turn Indyarocks is required to collect the same from the enterprise having caused the violation.  Additionally, after 6 complaints TRAI will suspend the sender for a period of 2 years.
